Cipta Kerja Kluster Ketenagakerjaan dalam Peningkatan Kesejahteraan Pekerja di Indonesia yang Berbasis Nilai Keadilan Sosial

Abstrak
Dengan munculnya Undang-Undang Cipta Kerja atau UU no 11 tahun 2020 dimana undang-undang ini tidak bersumber dari nilai–nilai sosial budaya bangsa Indonesia sendiri tetapi lebih mengutamakan syahwat politik, di mana politik hukum sangat berperan bagi penguasa atau pemerintah untuk membangun hukum nasional di Indonesia yang dikehendaki. Peran politik hukum terhadap pembangunan hukum nasional di Indonesia tidak bisa dilepas dari kontek sejarah. Sepanjang sejarah Negara Republik Indonesia telah terjadi perubahan-perubahan politik secara bergantian (bedasarkan periode sistem politik) antara politik yang demokratis dan politik otoriter. Sejalan dengan perubahan-perubahan politik itu, karakter produk hukum juga berubah. Terjadinya perubahan itu karena hukum merupakan produk politik, maka karakter produk hukum berubah jika politik yang melahirkannya berubah. Misalnya Undang-Undang no 13 tahun 2003 yang belum sempurna, harusnya lebih di sempurnakan bukan membuat Undang-Undang baru yang tidak lebih baik dari yang sebelumnya. Paradigma pembangunan di bidang ketenagakerjaan perlu direformasi yang dulu cenderung melihat pekerja sebagai faktor produksi dan atau bagian dari komoditi, harus diubah kepada pekerja sebagai manusia Indonesia seutuhnya atau sebagai subjek/pelaku proses produksi dalam pembangunan dengan segala harkat dan martabatnya. Perubahan paradigma ini pada akhirnya akan mengarah dan menentukan politik hukum kebijakan pemerintah dalam bidang ketenagakerjaan melalui suatu perubahan yang resolutif-kompositif dengan memandang pekerja sebagai subjek dan secara proporsional memperhitungkan seluruh aspek dalam suatu kesatuan yang holistic, agar kebijakan politik hukum yang reformatif ini tidak dipandang hanya bagus dimaterinya saja, maka perlu diimplementasikan melalui program yang titik beratnya bukan hanya sekedar instrumen tetapi akses yang mendorong kuantitatif dan mendidik kualitatif dalam membangun sistem keseimbangan antara yang seharusnya dengan kenyataan.

Abstract
With the emergence of the Job Creation Law or Law no. 11 of 2020 where this law is not derived from the socio-cultural values of the Indonesian nation itself but rather prioritizes political shahwat, where legal politics plays a very important role for the ruler or government to build the desired national law in Indonesia. The role of legal politics in the development of national law in Indonesia cannot be separated from the context of history. Throughout the history of the Republic of Indonesia there have been alternating political changes (based on the period of the political system) between democratic politics and authoritarian politics. In parallel with those political changes, the character of legal products has also changed. The occurrence of change is because the law is a political product, so the character of the legal product changes if the politics that gave birth to it changes. For example, Law no. 13 of 2003, which is rudimentary, should be more perfected, not create a new law that is no better than the previous one. The development paradigm in the field of labor needs to be reformed which used to tend to see workers as a factor of production and or part of commodities, must be changed to workers as a whole Indonesian people or as subjects/actors of the production process in development with all their dignity and dignity. This paradigm shift will eventually lead to and determine the legal politics of government policy in the field of labor through a resolutive-composite change by viewing workers as subjects and proportionally taking into account all aspects in a holistic unity, so that this reformative legal political policy is not seen as only good in its material, it needs to be implemented through programs whose emphasis is not just an instrument. but access that encourages quantitative and qualitative education in establishing a system of balance between what it should be and reality.
