Abstrak

Sanksi pidana yang dijatuhkan terhadap terpidana Heryanto alias Anto masih sangat ringan, mengingat tindak pidana yang dilakukan pelaku mengakibatkan luka pada korban dan akan mengakibatkan trauma dimana korban tersebut adalah istri dan anak terpidana sendiri. Meskipun dengan adanya alasan yang meringankan pidananya. Sanksi pidana yang dijatuhkan terhadap terpidana Heryanto alias Anto tidak cukup untuk menimbulkan efek jera yang memberikan rasa takut bagi terpidana pada khususnya, dan khalayak ramai pada umumnya, sebagaimana fungsi pidana pada mestinya. Adanya ketentuan teori pemidanaan yang tentang ancaman pidana yang diketahui oleh masyarakat umum inilah yang dapat membuat setiap orang menjadi takut untuk melakukan kejahatan karena melihat teori pemidanaan relatif yang mempunyai tiga macam sifat yaitu, bersifat menakut-nakuti, bersifat memperbaiki dan membinasakan.

Abstract

The criminal sanctions imposed on the convictEd Heryanto alias Anto are still very light, considering that the criminal acts committed by the perpetrator result in injuries to the victim and will result in trauma where the victim is the wife and child of the convict himself. Although in the presence of reasons that alleviate his criminal conviction. The criminal sanctions imposed on the convictEd Heryanto alias Anto are not enough to cause a deterrent effect that provides fear for the convict in particular, and the general public in general, as the criminal function should be. The existence of a provision of the theory of punishment about criminal threats known to the general public is what can make everyone afraid to commit a crime because they see the theory of relative punishment which has three kinds of traits, namely, it is scaremongering, improving and destroying.
