Netralitas Pegawai Negeri Sipil dalam Pemilihan Umum Kepala Daerah Tahun 2020 di Kabupaten Humbang Hasundutan

Abstrak
Pemilihan umum kepala daerah merupakan perwujudan demokrasi. Hak pilih dimiliki oleh masyarakat, termasuk pegawai negeri sipil. Yang menjadi pembeda adalah pegawai negeri sipil harus bersikap netral, terbebas dari pengaruh kepentingan partai politik ketika melakukan aktivitas pelayanan publik. Kabupaten Humbang Hasundutan merupakan salah satu kabupaten yang menyelenggarakan pemilihan umum kepala daerah tahun 2020. Penelitian ini merupakan penelitian hukum empiris dan menggunakan data primer sebagai utama yang didukung data sekunder sebagai data pendukung. Data yang diperoleh dianalisis secara kualitatif untuk selanjutnya diambil kesimpulan dengan menggunakan metode berpikir induktif. Hasil penelitian memperlihatkan bahwa pelaksanaan asas netralitas pegawai negeri sipil dalam pemilihan umum kepala daerah di Kabupaten Humbang Hasundutan belum sepenuhnya berjalan sesuai dengan peraturan perundang-undangan. Selama masa pemilihan kepala daerah terdapat sebanyak 5 (lima) pelanggaran terkait netralitas pegawai negeri sipil berupa mengampanyekan pasangan calon di media sosial facebook. Faktor yang menyebabkan oknum pegawai negeri sipil pelaku pelanggaran di Kabupaten Humbang Hasundutan tidak netral pada saat pelaksanaan pemilihan umum kepala daerah adalah motivasi untuk mempertahankan jabatan dan Kabupaten Humbang Hasundutan yang masih tergolong daerah yang homogen yang masih erat dengan hubungan marga dan kekerabatan.

Abstract
General elections for regional heads are a manifestation of democracy. The right to vote belongs to the public, including civil servants. What makes the difference is that civil servants must be neutral, free from the influence of political party interests when carrying out public service activities. Humbang Hasundutan Regency is one of the regencies that will hold the 2020 regional head election. This research is empirical legal research and uses primary data as the main data supported by secondary data as supporting data. The data obtained was analyzed qualitatively for further conclusions to be drawn using inductive thinking methods. The results of the study show that the implementation of the neutrality principle of civil servants in the regional head election in Humbang Hasundutan Regency has not fully complied with the statutory regulations. During the regional head elections there were 5 (five) violations related to the neutrality of civil servants in the form of campaigning for candidate pairs on Facebook social media. The factor that caused the civil servants who committed the violations in Humbang Hasundutan Regency to not be neutral during the regional head elections was the motivation to maintain office and Humbang Hasundutan Regency which was still classified as a homogeneous area that was still closely related to clan and kinship relations.
