Perlindungan Hukum Terhadap Konsumen Dan Pelaku Usaha Dalam Transaksi Jual Beli Barang Secara Online

Abstrak
Perlindungan hukum terhadap para pihak yang melakukan transaksi jual beli barang melalui online sudah menjadi kebiasaan masyarakat Indonesia. Kemudahan dan efisiensi menjadi alasan utama banyak masyarakat yang menginginkan mekanisme jual beli secara online. Tujuan penelitian ini untuk mengetahui bagaimana perlindungan hukum yang diberikan oleh negara melalui peraturan perundang-undangan terhadap masyarakat sebagai konsumen yang berhubungan dengan transaksi elektronik (e-commerce) dengan pelaku usaha selaku penjual. Beberapa hukum positif terkait peraturan perdagangan di Indonesia, khususnya e-commerce antara lain UU Perlindungan Konsumen dan UU ITE memberikan gambaran tentang apa saja hal-hal penting yang menjadi hak-hak dan kewajiban para pihak yang bertransaksi. Dengan menggunakan metode penelitian hukum normatif, pendekatan peraturan perundang-undangan (statute approcah), maka didapat hasil penelitian bahwa: l) Legalitas transaksi jual beli secara online diatur dalam Pasal 47 dan 48 PP Nomor 2008 tentang Penyelenggaraan Sistem dan Transaksi Elektronik; 2) Hak-Hak dan Kewajiban Konsumen dan Pelaku Usaha diatur dalam Pasal 4 s.d. 7 UU Perlindungan Konsumen; 3) Perlindungan Hukum terhadap Konsumen dan Pelaku Usaha dalam transaksi jual beli barang secara online diatur secara jelas dan runut dalam beberapa pasal pada UU Perlindungan Konsumen dan UU ITE, Pasal 4 UU Arbitrase dan Alternatif Penyelesaian Sengketa, serta Pasal 84 PP Nomor 82 Tahun 2012 tentang tentang Penyelenggaraan Sistem dan Transaksi Elektronik.

Abstract
Legal protection for parties who make online buying and selling transactions has become a habit of the Indonesian people. Ease and efficiency are the main reasons many people want an online buying and selling mechanism. The purpose of this study is to find out how the legal protection provided by the state through laws and regulations to the public as consumers related to electronic transactions (e-commerce) with business actors as sellers. Several positive laws related to trade regulations in Indonesia, especially e-commerce, including the Consumer Protection Law and the ITE Law, provide an overview of what are the important things that are the rights and obligations of the transacting parties. By using normative legal research methods, the approach to laws and regulations (statute approcah), the results of the study were obtained that: l) The legality of online buying and selling transactions is regulated in Articles 47 and 48 of PP Number 2008 concerning the Implementation of Electronic Systems and Transactions; 2) The Rights and Obligations of Consumers and Business Actors are regulated in Articles 4 to 7 of the Consumer Protection Law; 3) Legal Protection of Consumers and Business Actors in online buying and selling transactions is clearly and in order in several articles in the Consumer Protection Law and the ITE Law, Article 4 of the Arbitration Law and Alternative Dispute Resolution, and Article 84 PP Number 82 of 2012 concerning the Implementation of Electronic Systems and Transactions.
