AbstrakPerjanjian kerja merupakan salah satu syarat bagi pekerja/buruh untuk bisa bergabung dalam suatu peusahaan, salah satunya adalah perjanjian kerja waktu tertentu,ini marak dilakukan oleh perusahan basar yang sudah lama berdiri, hak ini memicu dalam perselisihan hak antar pekerja dengan perusahaan, hingga sampai pada Pengadilan Hubungan Industrial, tak jarang Majelis Hakim memberikan putusan yang tidak memihak kepada pekrja walaupun bukti-bukti yang ada sudah jelas. Rumusan masalah dalam penelitian ini adalah bagaimana penerapan perjanjian kerja waktu tertentu pada PT Diamond Cold Storage menurut Undang-undang 13 tahun 2003 tenatng ketenagakerjaan dan mengapa gugatan perkara 229/Pdt.Sus-Phi- 2015/PN.Bdg dinayatakan sudah kadaluwarsa, metode dalam penelitian ini adalah yuridis normatif dengan bahan hukum sekunder dan primer, dari penelitian ini penulis berkesimpulan setiap perusahaan yang menggunakan sitem perjanjian kerja waktu tertentu harus meperhatikan jenis usaha dari perusahaan tersebut serta meprhatikan perundang-undangan.

Abstract
The employment agreement is one of the conditions for workers / laborers to be able to join a company, one of which is a certain time work agreement, this is rampantly carried out by long-established basar companies, this right triggers in rights disputes between workers and companies, until it reaches the Industrial Relations Court, not infrequently the Panel of Judges gives impartial decisions to the creditor even though the existing evidence is clear. The formulation of the problem in this study is how the application of a certain time work agreement to PT Diamond Cold Storage according to Law 13 of 2003 is tenatng employment and why the lawsuit case 229 / Pdt.Sus-Phi- 2015 / PN.Bdg is stated to have expired, the method in this study is normative juridical with secondary and primary legal materials, from this study the author concludes that every company that uses a certain time work agreement system must pay attention to the type of business of the company and pay attention to the legislation.
