Upaya Hukum Banding yang di ajukan oleh terdakwa atas putusan Pengadilan Negeri Kota Bumi Nomor 191/Pid.Sus/2021/PN.Kbu tentang tindak pidana narkotika. Putusan Pengadilan Negeri Kota Bumi dilakukan pemberlanjutan berupa upaya hukum banding yang dilakukan oleh pihak terdakwa yang dirasa kurang memenuhi nilai keadilan dalam menjatuhkan putusan masa penahanan kepada terdakwa. Berdasarkan hasil penelitian, Faktor penyebab pelaku melakukan tindak pidana narkotika di Kabupaten Kota Bumi berdasarkan Putusan Nomor 191/Pid.Sus/2021/PN.Kbu antara lain Faktor lingkungan, Faktor perekonomian, Pemahaman agama yang kurang. Dasar pertimbangan hakim pada tingkat banding dalam kasus tindak pidana narkotika berdasarkan Putusan Pengadilan Tanjung Karang Nomor 120/PID/2021/PT.TJK didasarkan pada alat bukti, dakwaan dan tuntutan jaksa penuntut umum, hal-hal yang memberatkan dan meringankan terdakwa.

Kata Kunci: Dasar Pertimbangan Hakim; Tindak Pidana Narkotika; Upaya Hukum Banding.

 

Abstract

Appeals filed by the defendant against the decision of the Bumi City District Court Number 191/Pid.Sus/2021/PN.Kbu regarding narcotics crimes. The decision of the Bumi City District Court was carried out as a continuation in the form of an appeal by the defendant who was deemed to have failed to meet the value of justice in passing the decision on the detention period to the defendant. Based on the results of the study, the factors causing the perpetrators to commit narcotics crimes in Kota Bumi Regency based on Decision Number 191/Pid.Sus/2021/PN.Kbu include environmental factors, economic factors, and lack of religious understanding. The basis for the judge's consideration at the appeal level in the narcotics crime case based on the Tanjung Karang Court Decision Number 120/PID/2021/PT.TJK is based on evidence, indictments and demands of the public prosecutor, things that incriminate and relieve the defendant.
