Hubungan Kemitraan bagi Mitra Driver Online Antara Indonesia dan Inggris di Era Gig Economy: Studi Komparasi

Abstrak
Teknologi dan internet telah secara drastis mengubah kehidupan manusia, menciptakan ruang dan waktu yang tak terbatas bagi kelompok sosial. Perubahan ini juga melahirkan ekonomi gig, dimana orang menciptakan platform digital yang menawarkan fleksibilitas, kemudahan, dan biaya rendah. Namun, pekerja sering menderita karena dikategorikan sebagai “mitra” bukan karyawan, terutama dalam industri transportasi daring. Penelitian ini bertujuan untuk membandingkan regulasi hukum hubungan kemitraan pengemudi di Indonesia dan Inggris, memahami kondisi kemitraan bagi pengemudi di kedua negara, serta mengatasi paradoks dalam hubungan tersebut. Metode yang digunakan adalah pendekatan doktrinal yang berfokus pada sumber hukum sekunder, dengan penelitian yang bersifat deskriptif dan analitis. Penelitian menunjukkan bahwa regulasi di Indonesia belum sepenuhnya mengakomodasi kompleksitas kemitraan ekonomi gig, sementara regulasi di Inggris lebih adaptif. Studi ini menemukan kelemahan signifikan dalam perlindungan hukum dan kesejahteraan bagi pengemudi di Indonesia dibandingkan dengan Inggris, menyoroti paradoks dan ketidakadilan yang dihadapi para pekerja ini.

Abstract
Technology and the internet have drastically changed human life, creating unlimited space and time for social groups. This shift has also given rise to the gig economy, where people create digital platforms offering flexibility, convenience, and low costs. However, workers offten suffer as they are classified as “partners” rather than employees, especially in the online trarnsportation industry. This study aims to compare legal regulations of driver-partner relationships in Indonesia and the UK, understand the conditions for driver-partners in both countries, and address the paradoxes in these relationships. Methods used are doctrinal approach focusing on secondary legal soruces, the research is descriptive and analytical. Research shows that Indonesian regulations do not fully address the complexities of gig economy partnerships, while UK regulations are more adaptive. The study finds significant weaknesses in legal protection and welfare for driver-partners in Indonesia compared to the UK, highlighting the paradoxes and injustices faced by these workers.
