Implementasi Hukum Benda (Zaak) dalam Perspektif Hukum Perdata Indonesia

Abstrak
Penelitian ini membahas implementasi hukum benda (zaak) dalam perspektif hukum perdata Indonesia. Hukum benda merupakan bagian dari hukum perdata yang mengatur hubungan hukum antara subjek hukum dengan benda, termasuk hak kepemilikan dan penguasaan. Studi ini mengkaji berbagai konsep dasar hukum benda, seperti hak milik, hak guna usaha, hak guna bangunan, hak pakai, dan hak sewa, serta penerapannya dalam praktik hukum di Indonesia. Penelitian ini menggunakan metode normatif dengan pendekatan perundang-undangan dan analisis kasus. Hasil penelitian menunjukkan bahwa meskipun sudah ada pengaturan yang cukup komprehensif mengenai hukum benda dalam Kitab Undang-Undang Hukum Perdata (KUHPerdata), masih terdapat berbagai tantangan dalam implementasinya, seperti ketidakjelasan batas-batas hak dan tumpang tindih kewenangan antar instansi. Oleh karena itu, penelitian ini menyarankan perlunya penyesuaian regulasi dan peningkatan koordinasi antar lembaga terkait untuk meningkatkan efektivitas penerapan hukum benda di Indonesia.

Abstract
This research discusses the implementation of the law of objects (zaak) in the perspective of Indonesian civil law. The law of objects is part of civil law that regulates legal relations between legal subjects and objects, including ownership and control rights. This study examines various basic concepts of the law of things, such as property rights, business use rights, building use rights, use rights, and rental rights, as well as their application in legal practice in Indonesia. This research uses a normative method with a statutory approach and case analysis. The results show that although there is already a fairly comprehensive arrangement regarding the law of objects in the Civil Code (KUHPerdata), there are still various challenges in its implementation, such as unclear boundaries of rights and overlapping authority between agencies. Therefore, this study suggests the need for regulatory adjustments and increased coordination between relevant institutions to improve the effectiveness of the implementation of the law of objects in Indonesia.
